Full Fifth Circuit Rules Detained Immigrants Have No Constitutional Right to Bond Hearings
The full U.S. Court of Appeals for the 5th Circuit ruled 10-7 on October 23 that the Fifth Amendment does not require bond hearings for detained immigrants, reversing a July 2-1 panel decision that had required hearings after 90 days. Judge Cory Wilson wrote the majority opinion; Judges Dana Douglas and Leslie Southwick dissented. The Supreme Court agreed on October 1 to hear the separate statutory question of whether the law requires mandatory detention.
