Judge Orders ICE to End Unconstitutional Conditions in 26 Federal Plaza Hold Rooms

U.S. District Judge Lewis A. Kaplan issued a 125-page permanent injunction on September 24 finding that ICE “has overcrowded severely the 26 Fed hold rooms, subjecting detainees for extended periods to inhumane conditions that violate the Constitution.” The order covers every floor used for detention and requires clean space, bedding, hygiene supplies, meals, medical screenings and confidential attorney calls, and lets lawyers keep inspecting logbooks. Kaplan wrote that ICE had “sanitized the record.” The case was filed in August 2025 and tried in May.
