Federal Judge Orders ICE to Release Brazilian Father Detained While Fishing Off Martha’s Vineyard With His Son
Rogerio da Silva Lima and his 15-year-old son were detained by the Coast Guard while fishing south of Martha’s Vineyard and transferred to ICE custody after officers found an outstanding 2023 removal order. On May 26, U.S. District Judge Indira Talwani ordered da Silva Lima released, finding that ICE had likely missed the 90-day statutory window to detain and remove him after his asylum appeal was denied in February 2024. His son had been released days earlier to an adult brother.
